The works for the bottom stadium in Rocca di Mezzo, in the heart of the Sirente Velino Regional Natural Park, are “illegal” according to a note sent by the managers of the communal use management on which the work falls, the ASBUC of Rovere.
In the letter sent on February 20th to the VIA Committee of the Region, which is examining, post facto (!), the Environmental Impact Assessment of the intervention, the ASBUC writes:
“The fact is that, to date, there are extensive excavation works carried out on lands burdened by communal use without the availability of the municipal administration, without prior demanialization, without authorization and therefore to all intents and purposes to be considered illegal.“
According to the ASBUC, the urban planning variation and the related Strategic Environmental Assessment would also be necessary, which according to the Municipality would not be necessary as it would be a public work. In truth, since the land is of a demesne nature, the project must undergo the urban planning variation procedure and be subject to the SEA procedure. At the moment, the intervention project has never been approved by the municipal council of Rocca di Mezzo (a prerequisite expressly referred to in the application procedure of art. 19 of the aforementioned Legislative Decree).”
The procedure of retrospective and posthumous Impact Assessment is not viable according to a judgment of the Council of State since it must be preventive of the intervention, but for the associations, it is literally unheard of that the same VIA Committee did not immediately close the file once it was verified that the lands in question are burdened by communal use and that the municipality of Rocca di Mezzo has even started a construction site without having the availability of the areas.
It would be like building a house on someone else’s land without even asking for permission from the owner!
Last but not least, after the requests for clarification from the VIA committee regarding the conformity of what has been done with the project examined at the time – it is surreal that one can even speak of conformity for a project lacking authorizations! – the works director with a note of February 22nd, 2024, has also admitted that compared to the plans, the works are different with a rotation of several meters. What more needs to be added, conclude the associations, so that the judicial authority, to which these notes have been sent by the associations, the Sirente-Velino Park, the regional commissioner for communal uses, and the VIA committee, order the immediate restoration of the areas illegally excavated in the protected area?
